• Users of our cloud-based Subscription Services
• Coaches or trainers granted access to user data by the customer

This Policy does not apply to third-party websites, gym equipment manufacturers, or services not controlled by BenchMark Fitness, LLC.

2. Information We Collect

2.1 Information You Provide Directly

We may collect information you voluntarily provide, including: Name, Email address, Account login credentials, Billing and transaction details (processed by third-party payment processors), and Customer support communications.

2.2 Device & Performance Data

When you use the Device, we collect performance-related data generated by the Device, including but not limited to:

• Velocity, acceleration and measurement data collected by our devices
• Load and resistance measurements
• Repetition counts
• Timestamps and session identifiers
• Derived performance metrics, analytics and recommended techniques pertaining to equipment use

2.3 Account & Usage Data

We may automatically collect device identifiers, IP addresses, browser types, log files, and feature usage data. We may collect information about your approximate location derived from your IP address or Bluetooth signals for the purpose of device pairing and regional service optimization.

3. How We Use Information

We use collected information to provide, operate, and maintain the Services; enable device setup; generate AI-driven recommendations; provide support; and improve product safety.

We use de-identified and aggregated performance data to train and improve our proprietary machine-learning models. This data does not identify you personally.

4. Data Ownership Rights

• Raw Sensor Data: Owned by you, the customer
• Processed Analytics: Owned by BenchMark Fitness, LLC.
• Aggregated & Anonymized Data: Owned by BenchMark Fitness, LLC.

Customers grant BenchMark a perpetual, irrevocable, royalty-free license to use raw sensor data solely to operate and improve the Services.

5. Data Retention

Without a subscription service, performance data may be overwritten after approximately 45 days. With an active subscription, data is retained according to the selected plan. Aggregated and anonymized data may be retained indefinitely.

6. Data Sharing & Disclosure

We do not sell personal data. We may share information with trusted service providers (Cloud hosting, Payment processors), for legal/safety requirements, or in the event of a business transfer/merger.

7. Children's Privacy

Our Services are not directed toward children under 13. Minors may use gym equipment with the Device installed only under adult supervision.
